 SPECIMEN CHARITABLE TRUST DEED

THIS INDENTURE is made at (PLACE) _____th day of October, 2024

Mr. ______________ S/o. _____________________ having PAN ____________ residing at _______________________________________(Address),hereinafter referred to as “THE SETTLORS” (Founders) (which expression Shall unless repugnant to the context or meaning thereof be deemed to include his heirs, executors or administrators of the ONE PART

and

hereinafter referred to as “THE TRUSTEES” (which expression shall, unless repugnant to the context or meaning thereof, be deemed to include the survivors or survivor of them and the heirs, executors or administrators of the last survivor and the trustee or trustees for the time being of the trust hereby declared and their heir or assigns) of the OTHER PART.
WHEREAS the Settlor is desirous of setting up of a public charitable trust for Rs. 1,000 ( One  Thousand Rupees Only) Charitable purposes.

AND WHEREAS the trustees have agreed to act as first trustees of the said trust.

NOW THIS INDENTURE WITNESSETH that with a view to perpetuate the said desire and in consideration of the premises and for other diverse good causes and consideration him thereunto moving, He the Settlor grant, assign, transfer and hand over to the Trustees and the Trustees do accept and take possession of the said sum of Rs. 1,000/- (Rupees 0ne Thousand Only) hereinafter for brevity’s sake called “the Trust Estate” (which expression shall include all assertions thereto by way of donations or otherwise and the investments for the time being representing the same) TO HOLD the Trust Estate upon the Trusts and with and subject to the powers, provisions, agreements and declarations, hereinafter Contained or concerning the same i.e.

VISION MISSION OF THE TRUST

The core mission of the trust is to work towards poverty alleviation thus promotion of and support to sustainable livelihood models that contribute to sustainable development of the poor, the Marginalized and the Oppressed, by providing Education, Healthcare facilities without any caste creed or colour.

OBJECTIVES OF THE TRUST

I. Objectives relating to Education
• To Provide Quality Education and best infrastructure
• To help students achieve academic excellence and brilliance in all fields of life.
• To develop the feeling of universal brotherhood among students and staff.
• To develop scientific approach in students for crystal clear thinking.
• To develop technical skills in students.
• To orient them to a sense of responsibility towards self, society and the nation.
• To develop leadership and management qualities in students.
• To inculcate in the students rich moral, social and professional ethics so that they could do justice to their role as ‘Nation-Builders’.
• To make the students adhere to the discipline of the institute in its true letter and spirit.
• The Trust aims at providing the kind of education which makes the youth physically fit, emotionally balance, morally uplifted, spiritually awakened, intellectually enriched, academically sound, personally adjusted, professionally proficient, socially enlightened, nationally highly sought after and internationally acknowledged.
• To provide, establish, maintain, control and manage schools and educational institutions had to do all such acts, deeds and things, as may be conducive for the growth and progress of the institutions
• To print and publish books and literature Page Total.
• To work for National Integration and defence of the Country through education
• To give loans, scholarships, prizes and monetary assistance to the deserving students.
• Construction and running of Schools, colleges, education institutions, free dispensaries, Centres for poor feeding and homes for the aged for the benefit of the public
• Providing for grants, scholarships, fellowships and other forms of financial assistance to the needy and deserving students for pursuing education, vocational training, skill development etc.
• Granting of financial assistance to any educational institution for granting scholarships, prizes, medals, awards for excellence in studies, sports and scientific research, distribution of books and note books for poor and deserving students.
• Establishment, acquisition, maintenance and support of Schools, Colleges, Vidyapiths, Bal Mandirs, Study Centres, Research Institutes, Universities and other institutions or funds imparting education and training of students;
• Establishment and support of Professorships, Lectureships, Fellowships, Scholarships and prizes and establishment of endowments at any schools, colleges, universities or other institutions for promotion of education and knowledge.

II Objectives relating to Financial. General and Social wellbeing

 To facilitate empowerment of the poor irrespective of caste, creed, color and religion.
 To uplift the people residing in villages of the country morally, socially & financially
 To eradicate poverty, provide better life, foster cooperation and unity among people.
 To facilitate empowerment of the poor irrespective of caste, creed, color and religion.
 To promote self-employment and other ventures for the benefits of weaker sections.
 To Strengthen grass root level capacities by building confidence, problem solving capacity, resilience and skills among local people.
 To ensure people’s involvement in developing a society wherein peace, justice and equality prevail.
 To ensure gender equality and freedom from discrimination.
 The Trust will provide monthly sustenance or loans or set up endowments to relieve economic and social hardships, and enable to rebuild the life of the beneficiary.
 The Trust will make universal provisions for the general welfare of its beneficiaries, providing any aid or assistance, financial or otherwise, that the beneficiaries may need to get back and live a normal life.
 The Trust will support various stakeholders to enhance the quality of their disaster prevention and management preparedness.
 To develop and mobilize Community and Natural Resources to give the right direction to people of the marginalized and economically weaker section of the trust for their sustainable overall development.
 To promote charitable values, literature, science, art, education and culture

III Objectives relating to healthcare & Medical facilities

 To provide financial help for medical treatment, counselling. guidance, and aid to restore Page physical and emotional health of the beneficiary.
 To provide, establish, maintain, control and manage hospital and Health facilities to do all such acts, deeds and things, as may be to provide Quality Health Care which is cost-effective and Community-centred in an environment which is clean, caring and responsive to the needs of the public.
 To serve as a Role Model of Health Care delivery system in India
 To create Awareness about the deadliest diseases like AIDs, cancer etc, amongst the people by running and setting up camps all through the country.
 To provide facilities for drinking water in the remote villages. In various parts of rural India, medical camps are run free of cost regularly.
 To safeguard the environment at global level efforts are made in enhancing the civil society’s role.
 Children from the slum are provided nutritious food and that too free of cost.
 Establishment, maintenance and support of dispensaries and hospitals with or without medical schools or colleges and nursing institutions for treatment of patients suffering from diseases of any kind and accident;
 Establishment acquisition and maintenance and support to hospitals, dispensaries, maternity homes, sanatoriums, study centre, medical schools, or colleges or institutions imparting medical knowledge;
 Grant subscription and donations to hospitals, dispensaries convalescent homes, asylums, nursing homes and other public institutions for administering medical relief upon such terms and conditions and for such period as the Trustees may think fit;
 Grant of medical help during epidemic, famine, flood, or earthquake or any unforeseen occurrence or an act of God or war like operations, riots, civil-commotion and such and similar Occurrences;

IV. Other Objectives

• Establishment, conduct, maintenance of old age homes, homes for physically challenged men, women and children and persons with similar disabilities and also for granting financial assistance to institutions performing similar activities.
• Providing relief to the poor and advancing any other object of general public utility
• To do fundamental research, develop and propagate production & consumption of environmental and eco-friendly products and take related initiatives
• To have programmes for all-round development of villages and rural communities and other for the benefit of all the members of the community.
• he Trust will not carry out any activities with the intention of earning profit and will perform with service motive only.
• To promote National Integration, Communal Harmony, Universal Brotherhood and Global Peace.
• To promote and advocate Human Rights and Fundamental Freedom for all without any discrimination of race, religion, caste, color, sex and language

• To work with special concentration for the Child & Women Welfare.
• To organize and take up Health, Educational and Welfare programme for needy Women and children on priority basis.

• To conduct research studies on the social a economic conditions of people with a view to involving ways and means for their development with in their social historical frame works and to seek promotion of rural development such as provision of drinking water rural industrialization as well as Public Convenience for people
• To explore ways for promotion of socioeconomic development in the community.
• To undertake, organize, conduct and facilitate, Courses, conference, lecture, research and education on various aspects and of science, technology, trust and other fields.
• To train the downtrodden people in general for human resource development in view of the emerging needs such as database development, resource survey methodologies, computer, environmental, studies, health, education, and energy problems.
• To undertake and promote the publication & translation of journal, research papers and books and to develop the audio-visual programme to disseminate knowledge pertaining to the objectives of the trust.
• To work for the welfare of trust neglected and martingales people.
• To protest and fight against the injustice against people.
• To encourage and promote 22 family welfare activities among needy people
• To aid or establish any institution technical or otherwise, to promote education of art, Science or other related fields for the benefit of downtrodden and weaker sections of the trust.
• To arrange and provide medical aid and other assistance necessary for living to the needy people who are incapable or handicapped or mentally/physically retarded and financially unfit.
• To start and assist the relief measures in those parts of the country which become effected to natural calamities like famine, fire flood, earthquakes etc.
• To communicate and coordinate with the Govt. Local and public authorities on various issues related to development welfare and public interest on different subjects.
• To construct, maintain, alter, improve or develop any building belonging to the trust or works necessary or convenient for purpose of the trust.
• To arrange / establish and maintain centres of adult education, vocational education technical training, low cost education, formal & non-formal education.
• To aware people about various social issues to fight against evils.
• To issue appeals raise funds and accept gifts, donation subscriptions in cash or in kind and any property either movable or immovable for the achievement of the objective of the trust.
• To acquire, purchase or otherwise own or under take on loan or lease or hire temporality or permanently and movable or immovable property necessary or convenient for the furtherance of the objects of the trust.
• To organized and take-up Health, Educational and Welfare programmes for needy & poor Women & Children.
• To promote and protect Indian Traditional music, dance, handicraft, handlooms, Art, modern art& literature. To support the families and relatives of artists for promoting the budding artists in the trust;
• To establish an award for the deserving people in the field of Music, Art grass root level social service, communal harmony, brotherhood and peace.
• To encourage the emerging artists and their talents so that they can get proper recognition within and beyond the country.
• To establish centre(s) for the promotion of Music, Dance and other Arts
• To establish residential and non-residential cultural centres for promoting Music Dance-and other Arts. To work for Environmental Protection, Forestation, Plantation, Waste Land Management.
• To organized vocational training for women and needy people.
• To organized awareness camps, health camps, March, workshops, campaign and exhibition. To aware people about their democratic & fundamental rights.
• To promote cottage industries, Khadi, and traditional handicraft.
• To provide various medical services such as organizing health and awareness camps of Immunization, Eye Care, Motherhood, Child Care, and Communicable Diseases.
• To prevent any epidemics and to advocate both permanent and temporary measures of Family Planning.
• To provide basic medical facility, sanitation, general health care and other needful support which can be helpful for public to overcome sufferings and agony of any natural and manmade disaster and to facilitate them to rehabilitate.
• To provide medical, emotional, psychological, social and medical support to senior citizens of our trust by setting up various drop-in centres, senior citizen homes, old-age homes and other entertainment centres so that these highly honourable people should not be neglected.
• To undertake activities for sensitizing people to preserve the natural resources of our nation and to maintain the ecological balance of the area.
• To provide and facilitate legal assistance to underprivileged and poor section of trust to fight for their rights and justice.
• To promote, encourage and facilitate research programmes and trainings in the field of public health, education and empowerment.
• To arrange and organize religious, social and cultural programmes for all human being from time to time.
• To create a sense of brotherhood, love, humanity, affection, cooperation and friendship amongst the members of the trust and the beneficiaries.
• To make best efforts for promotion, development and protection of the population beneficiaries/ target and help them in distress.
• To help poor, widows, handicapped, orphans, old aged, mentally retired and under privileged section of the trust/community.
• To run/ operate different types of education program/schools like formal, non-formal, preschool for the education development of under privileged children of the community/trust.
• To run the different types of health programmes to raise the health status of vulnerable groups, poor and needy.
• To work for the empowerment and sensitization of women, adolescents and children.
• To make up efforts for the education, welfare and development of women, children and backward community in both urban and rural areas throughout the country.
• To establish the medical facilities in the working locality (if required) such as family planning centres, dispensaries, hospitals etc.
• To run and open the schools for the welfare and uplift of the needy children and also run adult education programmes.
• To publish books, magazines, charts, issue related IEC (information, Education and Communication) materials and other periodical illustration for generating the income for the trust for the benefit of its aims.
• To work and fight against discrimination based on Cast, Creed, Colour, Gender, Religion, Faith. Race& Nationality.
• To open / run / manage institute/ collage of higher/ professional/ vocation education in any part of the country for providing quality education and training to youth and children.
• To promote and protect natural herbs and plants by cultivation, preservation, storage, processing, demonstration, creating botanical garden and providing necessary training.
• To establish / run / manage hospitals, health centres, mobile health clinics, research centre to provide health care, counselling and referral services for all kinds of illness and deceases.
• To promote traditional therapies like Yoga, Naturopathy. Meditation, Acupressure, Acupuncture, Massage Therapy, Ayurveda, Homeopathy, Reiki etc.
• To established, build or manage Hostels, Short Stay Homes, Rehabilitation Centres, Shelters, crèches, Child Care Centre or Children’s Home, Counselling Centres and Help Line Centres for Women Children, Old aged persons, Drug addicts and needy persons.
• To work for the welfare of Agricultural workers, Farmers, Unorganized Labours, Industrial Labours and Migrated Labours.
• To form women groups, youth groups, self-help groups; old aged groups, adolescent groups, children groups/clubs, community leader’s groups and group of volunteers.
• To promote traditional games along with the contemporary sports among youth & others.
• To work against the exploitation of Animals & Birds and make sincere efforts to protect them.
• To establish Citizen Forum (s) and Resident Welfare Association (s) for the development of high values of the Unity, Brotherhood, Communal Harmony and Peace.
• To promote and support voluntary donation of Blood, Eyes and other parts of human body for the charitable purpose.
• To take-up, initiate or assist social development activities or welfare programmes for bringing positive change in the lives of the common people.
• To save or protect National Heritage, Buildings or Places of the archaeological & historic importance.
• To spread the teachings & thoughts of great leaders, philosophers, thinkers, reformers and saints.
• To include any other objective relating to the main objective of the Trust as decided by the Trustees in the Meeting of Trustees.

AND IT IS HEREBY DECLARED that the objects of the charitable trust hereinabove mentioned shall not be limited or restricted to any particular religion community caste or creed

NOW IT IS FURTHER DECLARED that trustees shall be entitled to utilize and disperse either the net income of the trust estate and/or parts of the corpus thereof for maintaining and/or conducting establishments for the charitable purposes and trust hereinabove set out and also as they in their discretion deem fit and proper to make contribution and/or donations to charitable institutions and/or establishments having one or more of the charitable objects hereinabove set out;

1. The Trustees shall have power and shall be entitled to collect, recover and receive dividends, rents, profits interest and other income of the TRUST ESTATE (hereinafter referred to as the “Trust Income”) and to pay all taxes, rates, assessments, expenses and outgoings for a collection in respect thereof and for the management of the TRUST ESTATE and for administering and carrying out the trust hereof.

2. The Trustees shall be entitled from time to time to accept from any person or persons desiring to make gifts or donation upon the TRUSTS and subject to the terms, provisions, powers and conditions contained therein such money or properties as the donor’s desire from time to time to give on the aforesaid trust and on the terms and conditions herein contained.

3. The TRUST hereby declared shall be designated as “XXXXXXXX CHARITY TRUST”.

4. The TRUST hereby declared shall be irrevocable.

5. It shall be lawful for the Trustees at any time and from time to time to borrow moneys as well as to sell, mortgage, assign, transfer, demise or let or lease for any period for however long or otherwise dispose of and deal with the TRUST ESTATE including any immovable properties comprised therein or any part thereof either by public auction or by private contract and on such terms and conditions as they the Trustees think fit with liberty to the Trustees to buy rescind or vary any contract for sale, mortgage, transfer, assignment, lease or other disposition without being answerable for any loss occasioned thereby and with power also to execute all necessary assignments, conveyances, mortgages, transfers, leases subleases and other deeds and assurances for the same and to give receipts and discharges for the consideration moneys and all other moneys. All moneys arising from any such sale, mortgage, transfer or other disposition shall be deemed to be part of the said estate and shall be dealt with accordingly.

6. The receipt of the Trustees for the purchase money of any property hereby directed or authorized to be sold, or for any other moneys, stocks, funds, shares, securities or investments paid delivered or transferred to them or him by virtue of these presents or in the execution of the Trusts or powers hereof shall effectually discharge the person or persons having delivered or transferring the same therefrom and/or from being bound to see to the application or being answerable for the loss or misapplication thereof.

7. The Trustees for the time being of these presents shall be respectively chargeable only for such moneys and securities as they shall respectively actually receive, notwithstanding their respectively signing any receipt for the sake of conformity and shall respectively be answerable and responsible only for their own respective acts, receipts, omissions, neglects and defaults and not for those of each other, nor for that of any bankers, brokers, auctioneer, or other person with whom or into whose hands any trust moneys or securities shall be deposited or come, nor the insufficiency in title or deficiency in value or any investments nor any other loss, unless the same shall happen through their own wilful default respectively AND ALSO the Trustees or Trustee for the time being may reimburse themselves, or himself or pay and discharge out of the Trust Estate all expenses incurred in or about the execution of the Trusts or powers to these presents.

8. The Trustees for the time being of these presents shall have full power to compromise or compound all actions, suits and other proceedings and all differences and demands and to refer any such differences or demand to arbitration and to adjust, settle and approve all accounts relating to the Trust Estate and to execute releases and to do all other things relating thereto without being answerable or accountable for any loss occasioned thereby

9. If and so often as any of the Trustees hereunder appointed or any future Trustees or Trustee of these presents shall die or shall leave India for more than one year or shall desire to retire from or refuses to act or become incapable to act in the Trusts of these presents or otherwise, it shall be lawful for the surviving or continuing Trustee or Trustees for the time being of these presents (and for this purpose to act in the execution of this power be considered to be continuing trustee) or for the proving executors or administrators of the last surviving Trustee to appoint a new Trustee in place of the Trustees or Trustee so dying or leaving India or desiring to retire from the Trust or otherwise to appoint new or additional trustee or trustees and upon every or any such appointment the number of Trustees may be augmented or reduced and upon every such appointment the Trust Estate shall be transferred so that the same be vested in the Trustee or Trustees for the time being of these presents AND the Trustees or Trustee so appointed as aforesaid may be well before as after such transfer of the Trust Estate act or assist in the execution of the trusts and powers of these presents as fully as effectually as if he had been hereby appointed as Trustee PROVIDED THAT the number of Trustees of these presents shall not be less than three nor more than nine PROVIDED HOWEVER AND IT IS HEREBY AGREED AND DECLARED for the sake of clarification that the present Trustees who have executed these presents shall remain Trustees during their lifetime or until such time as they retire or become incapable to act as such

10. Any Trustee may at any time resign by giving a month’s notice to his co-trustees and upon expiry of such period, he shall be deemed to have vacated his office.

11. The Trustees shall have the right to pass necessary resolutions by circulars instead of by meetings and any resolution as agreed to by a majority of the Trustees shall be as valid and effectual as a resolution of the Trustees at a meeting duly convened.

12. The Trustees shall determine all questions and matters of doubt in the execution of the Trusts, including the meaning and constructions of any of the articles and provisions herein contained and do all acts and execute all the trusts, powers and authorities appertaining in these presents, unanimously and in case of disagreement, by majority, each Trustee having one vote only. The Trustees shall be at liberty to make rules and bye- laws for the due administration of the Trust provided such rules and bye-laws are not inconsistent with what is herein contained.

13. For the purposes mentioned above or any of them, the Trustees shall be at liberty to enter into, sign execute and deliver all such contracts, deeds, assurances and writings as they may deem necessary or expedient. The Trustees shall also be entitled to incur all legitimate expenses which they consider to be beneficial to and in the interest of the Trust.

14. The Trustees shall be entitled to invest the Trust Estate or such other funds of the Trust as are not immediately required, in any of the investments authorized by the Bombay Public Trust Act, 1950 and/or the statutory amendments or modifications or re-enactment thereof for the time being in force or the Rules made thereunder and the Trustees shall also be at liberty to invest the Trust Estate or any part thereof on the Mortgage of any immovable property situated in any part of the Republic of India (either of Free Hold or Lease-Hold or any other tenure) and the Trustees shall also be entitled to purchase immovable properties, including vacant land of any tenure and to construct buildings and other structures thereon as the Trustees may consider necessary and in the interest of the Trust and they shall also be entitled to pull down and demolish and to rebuild any building or erection as they may consider necessary and in the interest of the trust, AND the Trustees shall have power to alter, vary or transfer the investments from time to time in such manner as the Trustees may think fit and proper and in the interest of the Trust.

15. The Trustees shall be entitled to obtain tenancies and/or take on lease any premises and/or properties as they may consider proper and in the interest of the trust.

16. Complete accounts of the Trust shall be properly kept at (city), or at such other place or places as the Trustees may from time to time decide and all the accounts, records and documents of the Trusts shall be maintained at the office of the – Trust. The accounts of the Trust shall be duly audited.

17.IT IS SPECIFICALLY DECLARED, as essential terms and condition of this Deed
a. That notwithstanding anything hereinbefore contained the income as also the corpus of the Trust Estate shall be applied and be applicable only to or for such territories only and subject to such conditions or limitations, if any as from time to time to be laid down in the Income Tax Act, 1961 or any other Act governing taxation of income or wealth as will ensure or make the Trust hereby -established and its income as eligible for exemption from taxation under the Income Tax Act, 1961 and any replacement or re-enactment thereof or modification thereof or under any such Act governing taxation of income or wealth for the time being in force in India; and

b. that the trust hereby established shall be one to which under the provisions of present section 80-G or any other such or similar provisions in the Income Tax Act, 1961 or any replacement or re-enactment or modification thereof or such or similar enactment’s for the time being in force in India, any donation – thereof should be recognized as eligible for exemption or relief from tax in regard to the donor under the said Acts and any such or similar legislation for the time being in force in India;

18. WITHOUT PREJUDICE to the generality of the foregoing purpose but subject to as aforesaid: 1. IT IS DECLARED that the Trustees shall each year apply the residue of the income of the Trust Estate and may at their discretion at any time and from time to time apply also Trust Estate or any part of the Trust Estate in or towards all or any one or more of the aforesaid categories of public charitable purposes aforesaid And without prejudice to generality of their powers and subject to the limitations or conditions contained above, in or towards any one or more of the follow and manner as the Trustees in their absolute discretion may think proper:

The Vision of the Trust being – Relief to the poor and needy in any manner as the Trustees may think fit: It is again expressly clarified that the only objects of the Trust are
a) Relief to the Poor:
b) Education;
c) Medical Relief

19. The Trustees may give or consent to give for advancement of any object of the Trust any loans to deserving and needy persons and shall have power in their discretion to charge or forego interest and/or to allow the repayment of the loans by such instalment and/or in such manner and upon such terms and conditions as the Trustees may in their discretion think fit and/or remit forego or omit to recover the whole or any part of such loan, interest thereof and to take or not to take any security and/or for such loans.

20. IT IS INTENDED AND DIRECTED that if at any time hereafter it is held that any of the objects or purposes to which the said income or any part thereof or corpus or any part thereof is directed to be applied or expended is not a public charitable object or purpose recognized for exemptions and relief under the provisions of the taxation laws referred to above or other laws then and in that case, the Trustees shall apply and expend the said income or corpus towards the execution and carrying out of such public charitable purposes as may be recognized under the Taxation Laws of India as above stated as The Trustees may think fit subject never the less to the directions and limitations contained in Clause 18 (3) viz that the object shall be or be comprised in any of three categories mentioned in Clause 18 (3).

21. IT IS HEREBY FURTHER AGREED AND DECLARED that the surplus and unapplied portion of the said income, if any, arising in any one or more year or years shall be accumulated by investing the same and the resulting income thereof from time to time in any of the investments in which the Trust Funds are directed or authorized to be invested and shall be credited to an account to be called “Surplus Account” and the Trustees shall have power in any subsequent year or years to expend and employ the same in the same manner and to the same extent as if such accumulations or parts thereof had been part of the income of the year in which the same are or is sought to be expended and employed as aforesaid subject to the provisions of Income-Tax Laws or any other laws that may be in force from time to time.

22.The 0ffice of the trust shall, in the first instance, be at

23. The Trustees shall be entitled to open and maintain Bank account as they may consider necessary or proper and such account or accounts may be operated on the signature of any of the Trustees severally and as decided by the Trustees in the Meeting.

24. Presently there is no moveable or immovable properties for the trust.

WITNESS IN WHEREOF the Settlor and the Trustees have hereunto set and subscribed their respective hands, the day and year first hereinabove written.
